Finding the Name of a Lawyer

Lawyers No Comments

There are many ways to get the names of some lawyers:
* Ask a friend, especially one who has had a problem like yours, for the name of his or her lawyer;
* Ask a professional person, such as a doctor, minister, social worker, banker, or business person whom you know and trust;
* Call your local bar association lawyer referral service. If there is no lawyer referral service in your area, call toll-free
1-877-9TEXBAR from anywhere in Texas to reach the statewide Lawyer Referral Service;
* Visit your local library. Many libraries have law directories, such as the Texas Legal Directory or Martindale-Hubbell, which
give a brief biography of lawyers practicing in your area and elsewhere; and
* Telephone directories contain listings of attorneys in your area. Some attorneys will list the areas of law in which they prefer to
practice. Others show themselves as being “board certified” in one or more specific areas of law, which means that the lawyer
has met certain criteria established by the Texas Board of Legal Specialization.

Choose The Right Lawyer For You

So you’ve been injured and want to hire a personal injury lawyer to help you get a fair settlement. Good idea…but where do you start? What should you expect? What questions should you ask?

If you’ve been seriously injured (your damages add up to more than $1,000) and you want to hire a lawyer, get on it quickly. Searching for and hiring a good lawyer might take some time, so the sooner you start the better.

This does not mean you should sign the contract right away. But you should begin meeting with lawyers within the first week or two after your injury. You could have a loved one start looking if you’re not physically capable.

A good lawyer brings a lot to the table - knowledge of the legal game, experience negotiating, etc. But they will also take a substantial amount of any settlement awarded to you - usually somewhere around 33%.

You should know it’s not absolutely necessary to get a personal injury lawyer. It really depends on your case. If you just want to file a claim (ask for money directly from the defendant and/or their insurance company) and your case is relatively straightforward, then you might be able to “go it alone.” This approach could save you a significant amount of money.
But if you’re like most people you’re not even considering the prospect of handling your own case. So naturally you’re going to hire a personal injury lawyer.

Making A Record

Lawyers No Comments

Q. What’s involved in “making a record?”

A. If you have been in a serious accident, chances are that someone has already made a record of what has happened to you. There already is a police report, an on-the-job worker’s compensation report or the like. If your condition required medical care, hospital records will confirm your injuries.

If you were injured at home, report your injuries to your doctor or health clinic and obtain all appropriate medical treatment. Appropriate treatment is that care recommended by a doctor.

If you have developed food poisoning, in addition to seeking medical care, immediately report your suspicions to the restaurant or store and the county or city health department.

Never hesitate to “get checked out” even when you feel “O.K., but shaken up.” Many times the onset of physical complaints begins 12 to 24 hours later. Maybe you did walk away from being rear-ended by a truck and only feel “shaken up” but tomorrow morning when you get out of bed it may be different.

See a doctor following the collision will insure a preliminary diagnosis and perhaps minimize the discomfort and future treatment you may need later.

Tell the doctor the complete truth and only the truth. Anyone who manufacturers symptoms and then makes a claim is guilty of fraud.

Follow the doctor’s advice. Do not substitute your judgment for that of an experienced medical professional. If you do, it will be used against you whether you over-treat or under-treat.

5 Tips on Choosing a Good Personal Injury Lawyer

1. A personal injury lawyer with a great deal of experience, and not just years of practice, but a track record of a favorable amount of successful negotiations is a major benefit to your case. Most personal injury claims are settled out of court. The defendants are often willing to pay out more money to the plaintiffs in order to avoid negative publicity, expensive trials, and even the possibility that the court may award the plaintiffs more money. If your personal injury lawyer has never won cases in court, the defendant in your lawsuit may not take the threat seriously.

2. Choose a personal injury lawyer that will take your case on a contingency fee basis - This is a fee that is charged at the end of the case and only if you win your litigation. This means that your lawyer doesn’t get paid unless you get paid. Personal Injury Lawyers who primarily represent people in accidents usually charge a contingency fee. Your lawyer will take the fee out of the money you receive for your injuries. A respectable personal injury lawyer will charge somewhere around 30% of your final settlement. Make sure you get all the details of the personal injury lawyer you choose to retain, up front.

3. Your personal injury lawyer is going to be your closest advisor. Martindale.com has a helpful lawyer locater service and will explain the rating system. Martindale-Hubbell rating is very informative. With over 1 million lawyers in their data base, see if you can locate a personal injury lawyer near you and meet them face-to-face.

4. Personal injury lawyers are listed in your local phone book, check their credentials against the Martindale-Hubbell rating and see if they are a good choice for you. 5. As with any legal representation, personal injury lawyers are specialists in their field and you can rest assured your insurance companies retain some of the best. Don’t choose a general case lawyer, specify a personal injury lawyer, with a high rating for the fairest litigation on your behalf.

Cool Site

I found a really neat and potentially helpful site that has a glossary of terms about law, to help people better understand all of the fancy jargon that lawyers tend to use.  The site is located at http://www.personalinjuryfyi.com/glossary.html and it offers the terms and a lot of other helpful information as well.  I like finding sites that are dedicated to helping people figure out things, and this is a site all about personal injuries.

Mortgages

I love shopping around for potential places to move. Yesterday I was taking a look at Scottsdale real estate because I have heard great things about it. The only thing is it seems like right now when you go to get a mortgage these companies want to mess with you. You should see a lawyer before signing any final papers for mortgages, because you never know what they may stuff in there.

Donda West’s Plastic Surgeon Faced Suits

American, Lawyers, Court cases No Comments

Dr. Jan Adams has “multiple convictions for alcohol-related offenses,” medical board executive director David Thornton said in his complaint charging Adams with violating the Medical Practice Act.  He has settled malpractice suits in the past as well.  This is coming from the news of Kanye West’s mother’s death the day after she got plastic surgery from Dr. Jan Adams.  Coincidence?  Probably not.

Picture of a Jackass

Before allegedly stealing a $400 camera from Circuit City, a suspect in Milford, Conn., snapped a photo of himself on a different camera on the display table. The photo was promptly given to media to find the picture not-so perfect crook.  I love it when criminals do stupid stuff like this.

Do you know this guy?    Anyone with information is asked to contact the Milford Police Department at (203) 878-6551.
